Quick Fix

A sudden increase in migrants at the southern border has given Republicans a new reason to hold up immigration reform in the Senate. Even bipartisan measures like the Farm Workforce Modernization Act, H.R. 1603 , which would create a path to citizenship for thousands of noncitizen farmworkers and broadly expand the H-2A temporary agricultural worker visa program, seems destined to languish in the closely divided chamber.

"There is no pathway for anything right now," Sen. Lindsey Graham (R-S.C.) said last week, the New York Times reports.

A GLIMMER OF HOPE? The Farm Workforce bill did draw 30 House GOP votes — far more than the Dream and Promise Act, which would provide a path to citizenship for an estimated 2 million undocumented immigrants who were brought to the U.S. as children.

Sens. Michael Bennet (D-Colo.) and Mike Crapo (R-Idaho) subsequently announced they will introduce a companion to the workforce bill, "and several additional Senate Republicans mentioned it as a possible priority," our Burgess Everett reports. When it comes to timing, Bennet's office told MS, the companion legislation will be introduced "soon" — whenever that is.

RECONCILIATION ROUND 2? With most items on their agenda hobbled by the Senate filibuster, the Congressional Hispanic Caucus is hoping Democratic leaders will use the same arcane budget process that let the party bypass GOP votes for its pandemic aid package to advance immigration bills, our Sarah Ferris reports.

"House Speaker Nancy Pelosi and Senate Majority Leader Chuck Schumer haven't formally decided to use the budgetary tool known as reconciliation for Biden's next major priority, an infrastructure and jobs plan," according to Sarah. "But given the Senate GOP's continued reluctance, many senior Democrats in both chambers believe it will be the ultimate path," she adds.

Hispanic Caucus chair Raul Ruiz (D-Calif.) told his colleagues on a call last week that Biden's comprehensive immigration plan should be included in the infrastructure bill, given that neither are likely to pass the Senate without the aid of the reconciliation process.

But senior Democrats acknowledge that substantial immigration legislation "would be difficult — if not impossible — to get past the Senate parliamentarian, the chamber's nonpartisan rules referee." (The same issue doomed Democrats' push to raise the minimum wage to $15 in the latest pandemic package.)

DRIVING THE WEEK

WALSH CONFIRMATION VOTE TODAY: The Senate this evening is expected to confirm Boston Mayor Marty Walsh to serve as Secretary of Labor. The vote is scheduled for 5:30 p.m. A DOL spokesperson said while timing on his swearing in is still in flux, Walsh is planning to "hit the ground running."

SUPREME COURT

SCOTUS TO HEAR UNION FARM ACCESS CASE: The high court today will hear oral arguments in Cedar Point Nursery v. Hassid, a case weighing whether a California state law that allows unions to access agricultural worksites to speak to workers about organizing violates the Fifth Amendment.

Two companies are challenging the state law, arguing union organizers' right to visit their land amounts to the government seizing private property without compensation. But the California Agricultural Labor Relations Board has countered that the law "serves a critical purpose by allowing unions face-to-face contact with farmworkers — a necessary means of informing this increasingly vulnerable community of their right to collectively organize." The case eventually made its way to the 9th Circuit, which upheld the state right-to-access law.

IMPACT: State and local governments have warned SCOTUS that "under the growers' approach, governments at all levels would face the prospect of having to pay private property owners whenever public officials need to enter the land — for example, to conduct health and safety inspections, such as home visits by social workers or to inspect coal mines, railroads or drug manufacturers," writes Amy Howe for SCOTUSBlog.

BORDER DISPATCH: Local officials and community leaders at the border "insist it's way past time for leaders in Washington to come up with long-term solutions that will help create better conditions in the migrants' home countries and allow those that still want to come to the U.S. to enter via a smooth and fair process," our Sabrina Rodriguez reports from Brownsville, Texas.

"Thousands of parents, most of them hailing from Central America and Mexico, are making the trip north," she writes, with the number expected to increase in March and the coming months. But so far, "their reception at the border is often contradictory and confusing," Sabrina explains, "partly because the U.S. government's capacity to handle the influx of migrants is limited — and partly because Mexico isn't always willing or able to receive them."

Washington to blame? "Biden's critics say his messaging is squarely to blame" for the thousands of migrant parents coming to the U.S. from Central America and Mexico, she writes. "But more than half a dozen asylum-seekers interviewed by POLITICO said they would make the trek regardless of who was in the White House. Some of their reasons: lack of job opportunities, concern for the safety of their family and devastation from last year's back-to-back hurricanes that walloped parts of Central America."

"The crisis is in Washington because it's the third administration that can't solve it," said Jim Darling, mayor of McAllen, Texas, a small city 60 miles west of Brownsville. "The only thing that could stop families is legislation and actually doing the work to help Central America — and that's not happening."

PROGRESSIVES CRANK UP PRESSURE FOR PUSH DEMOCRATS ON THE MINIMUM WAGE HIKE: California Rep. Ro Khanna and other Democratic lawmakers joined AFL-CIO President Richard Trumka, SEIU President Mary Kay Henry, Poor People's Campaign co-chair Rev. William J. Barber on a call last week to plot a path forward on raising the federal minimum wage.

"What is not negotiable is that we need to have a $15 minimum wage by the end of this year," Khanna said on Friday.

Khanna outlined three potential avenues to pass the wage boost, including making sure the provision can be ruled admissible in the next reconciliation bill, attaching the measure to must-pass legislation or getting rid of the filibuster and simply a wage hike bill with a simple majority.

On that last point: President Joe Biden signaled he was open to filibuster reform last week. More on that here.

DIVERSITY DISCLOSURES: "An adviser to the top U.S. securities regulator said on Friday his subcommittee will likely recommend new disclosures about diversity from registered investment advisers and other steps to improve minority representation in finance," Ross Kerber reports for Reuters . It's "the latest effort to shed more light on the small role held by women and ethnic minorities in the money management industry, although they could also show the obstacles regulators face in taking on social issues."

Driving the Day

KAHL COUNTDOWN: Could this be the week where we get some movement on the delayed nomination of Colin Kahl to be Pentagon policy chief? His hopes for getting through the Senate Armed Services Committee, let alone the full Senate, looked even dimmer on Friday with the news that moderate GOP Sen. Susan Collins will vote "no" over lingering concerns about his policy stances and partisan tweets, our colleague Burgess Everett reports for Pros.

"Some of Dr. Kahl's actions have raised questions about his ability to work with Congress in a thoughtful and productive manner," she said in a statement to POLITICO. "If America is going to successfully confront our toughest national security challenges, we need a nominee for this position who will help bring Republicans and Democrats together."

What does it mean? Unless another Republican on the panel backs him, centrist Democrat Joe Manchin, who remains undecided, could decide Kahl's fate. A party-line vote in the full Senate would also require Vice President Kamala Harris to cast a tie-breaking vote.

HEARING MENU: A series of congressional hearings is scheduled in the House and Senate this week.

On Tuesday, the SASC holds a nomination hearing for Navy Adm. John Aquilino to be head of the U.S. Indo-Pacific Command at 9:30 a.m.

The House Defense Appropriations Subcommittee holds a hearing on future defense spending at 2 p.m.

The House Armed Services Readiness Subcommittee holds a hearing with the vice chiefs of the military branches on "Learning From and Preventing Future Training Mishaps" at 3 pm.

On Wednesday, the House Armed Services Committee holds a hearing on extremism in the military with experts on radical movements at noon.

On Friday, the HASC Subcommittee on Intelligence and Special Operations hears testimony from former officials and nongovernmental experts on the culture and climate of special operations forces at 11 a.m.

And the HASC Readiness Subcommittee holds a hearing with top military officials on "Installation Resiliency: Lessons Learned from Winter Storm Uri and Beyond" at 3 p.m.

WAR POWERS VOTE: In what is likely to be the opening salvo in the renewed bipartisan push to overhaul congressional war powers, the House Foreign Affairs Committee this week plans to hold a vote on a measure to repeal the 2002 Authorization for Use of Military Force against Iraq.

It is one of several proposals in the House and Senate to repeal and replace outdated resolutions that underpin a series of conflicts, including the 2001 AUMF that justified two decades of counterterrorism operations across the globe.

War Report

TARGET FORT MCNAIR? A particularly disturbing report on Sunday revealed that Iran's paramilitary forces threatened to launch water-borne "USS Cole-style attacks" on Fort McNair along the Southwest D.C. waterfront, home to some of the Pentagon's top brass, the National Defense University, and the headquarters of the U.S. Military District of Washington.

The intelligence also revealed threats to kill Army Vice Chief of Staff Gen. Joseph Martin "and plans to infiltrate and surveil the base," The Associated Press reported, citing two senior U.S. intelligence officials.

"The intercepted chatter was among members of the elite Quds Force of Iran's Revolutionary Guard and centered on potential military options to avenge the U.S. killing of the former Quds leader, Gen. Qassem Soleimani, in Baghdad in January 2020, the two intelligence officials said."

The threats are a primary reason the Army wants to step up security around the post, the report said.

Flashback: It wouldn't be the first time the Quds Force has been fingered in a terrorist plot in the nation's capital.

AUSTIN IN AFGHANISTAN: "Defense Secretary Lloyd Austin made a surprise stop in Afghanistan on Sunday, his first as Pentagon chief, as top generals warn that the country could fall into chaos if U.S. troops withdraw before diplomatic efforts between the Taliban and the Afghan government to end the conflict yield results," our colleague Lara Seligman reports from Kabul for Pros.

Biden is still weighing whether to withdraw some 3,500 U.S. troops from Afghanistan by May 1, the deadline agreed to last year by the Trump administration in an agreement with the Taliban. But violence in the country remains too high.

"It's obvious that the level of violence remains pretty high in the country, we'd really like to see that violence come down," Austin told reporters after meeting with Afghan President Ashraf Ghani. "If it does come down, it can begin to set the conditions for some really fruitful diplomatic work."

A full pullout by May 1 looks unlikely, especially with little prospect of a peace deal between the Taliban and the Afghan government.

"If we withdraw and no deal was made with the Taliban, I think the government of Afghanistan is going to be in for a very stiff fight to retain possession" of urban population centers, Gen. Frank McKenzie, head of U.S. Central Command, said last week.

The militant group maintained it has abided by the agreement, Newsweek reports . While the Taliban have not targeted U.S or NATO troops since the February 2020 pact, attacks on Afghan security forces have increased.

U.S. defense officials insisted that if Biden decides to stick with May 1, they can still pull it off. "There's probably nobody who understands the physics associated with removing troops and equipment out of a place better than me," said Austin, who as a four-star general oversaw the 2011 withdrawal of combat troops from Iraq. "Whatever decision the president makes, you can trust it will be fully supported."

And progressives lawmakers have made it clear they will keep the pressure on to meet the May 1 deadline. "...It is long past time for the United States to end its military role in a complex conflict that predates our initial invasion two decades ago, Reps. Barbara Lee and Ken Buck wrote to Biden on Thursday.

'THAT WOULD TRIGGER SANCTIONS': Austin arrived in Afghanistan after a stop in India, where he warned New Delhi to drop plans to acquire the Russian-made S-400 anti-missile system, Lara also reports for Pros.

"We certainly urge all our allies and partners to move away from Russian equipment … and really avoid any kind of acquisitions that would trigger sanctions on our behalf," Austin told reporters.

U.S. officials, who have been trying to lure India away from Russia's orbit with growing arms sales and defense cooperation, insist that the S-400 cannot co-exist with U.S. equipment and can be used to collect intelligence on American capabilities, particularly the F-35 fighter jet.

The Biden administration is under increasing pressure from Congress to punish India like NATO ally Turkey when it acquired the S-400. Sen. Bob Menendez, who chairs the Foreign Relations Committee, told Austin in a letter last week that if India follows through, the move "will clearly constitute a significant, and therefore sanctionable, transaction with the Russian defense sector."

During his India visit, Austin met with Indian Prime Minister Narendra Modi to discuss ways to strengthen ties, particularly to confront China, Lara also reports for Pros. In subsequent talks with Indian Defense Minister Rajnath Singh, the two sides agreed to deepen their military ties, The Associated Press reported.

A PERSONAL TAKE: Austin, the first Black defense secretary, recalled in an interview with CBS' 60 Minutes that aired Sunday how he has personally confronted bias in the military, even when he was a senior general.

"It doesn't change as you climb the ladder. You still get the doubts," he told CBS's David Martin. There are always going to be people, because of what you look like, that will question your qualifications."

Industry Intel

FAR FROM A DONE DEAL: The government program to reimburse the salaries of contractors because federal facilities have been shuttered by the pandemic has been extended through September. But that's not the end of the story, as our colleague Julia Arciga points out in a new POLITICO Pro bill analysis.

"Even though Congress has authorized the program through September," she writes, "it has not appropriated any money for the Pentagon to actually pay contractors." The Pentagon reported last month it has reimbursed 84 companies a total of about $50 million.

The legislation, which was adopted as an amendment to the Covid relief package, has also not been without controversy. Some lawmakers have called it "an insult" to those who have to go to work every day in person. And it remains in doubt whether calls by influential trade groups to make it permanent will get traction.

Driving the Day

EXCHANGE PROGRESS ACCELERATING — The number of systems still vulnerable after the massive Microsoft Server Exchange hack fell by 45 percent last week, to less than 10,000 organizations in the U.S., a National Security Council spokesperson told MC on Monday. That's a sharp drop from the 120,000 systems that were at risk after the sweeping compromise was uncovered earlier this month.

Microsoft's one-click mitigation tool for companies running on-premises Exchange servers who don't have dedicated IT or security teams to install the security updates has been downloaded over 25,000 times since it was released last week, the spokesperson said. Anne Neuberger, the deputy national security adviser for cyber and emerging technology, had pressed the tech giant to design a simple solution for small businesses and organizations to fix the digital flaws that prompted a feeding frenzy by malicious online actors.

"With one click, the tool protects organizations against attacks, and also scans systems for known compromises established there by an attacker and remediates them," the spokesperson said. "We continue to strongly encourage everyone, including those that run this tool, to also update their Exchange Server for more complete protection." The spokesperson also noted that CISA "has published a number of helpful resources regarding ransomware as well."

FCC Corner

HOW DOES THIS SOUND TO YOU? — The FCC today is asking for public feedback on its planned implementation of a telecom equipment replacement reimbursement fund. In a Federal Register notice , the FCC explained how it plans to implement provisions in the fiscal 2021 appropriations bill that relate to the program, which is designed to mitigate the costs of replacing insecure communications equipment produced by vendors, such as Huawei and ZTE, that are linked to foreign adversaries.

The first change affects how many customers a company can have before it's considered too big to qualify for equipment replacement reimbursements. The 2019 Secure and Trusted Communications Networks Act originally restricted eligibility to companies with fewer than 2 million customers, but in the 2021 funding bill, Congress raised that ceiling to 10 million or fewer. The FCC is proposing to change its rules accordingly and wants public feedback about "any implications that [the change] may have" for the program.

The second change affects what kinds of Huawei and ZTE products can be replaced through the reimbursement program. The FCC initially decreed that only telecom equipment or services on its "Covered List" qualified. The list contained products that met three specific criteria, including posing "an unacceptable risk" to U.S. national security. But Congress included language in the funding bill that the FCC interpreted as requiring broader eligibility. The commission asked the public to provide comments on its interpretation of the law. "Would reimbursement for all Huawei and ZTE equipment better ensure the security of U.S. communications networks than a narrower scope of reimbursement?" the commission asked.

The commission also proposed changing its list of equipment that telecom operators must remove from their networks, in order to align that list with the new, broader definition of risky equipment that can be replaced with reimbursement program funds. And it described its plan for prioritizing the distribution of reimbursement funds, including by starting with companies serving fewer than 2 million customers. Industry stakeholders should review the full document for more changes on which the FCC is seeking public feedback.

NOT SHORTING THE SHORTAGE — Commerce Secretary Gina Raimondo on Friday vowed to focus on the country's shortage of semiconductors . "As Secretary of Commerce, combating the semiconductor shortage and investing in American manufacturing of semiconductor technology is going to be a priority of mine and I look forward to working alongside leaders like the Semiconductor Industry Association," Raimondo said in a statement released by the Commerce Department following a meeting with industry executives.

President Joe Biden recently issued an executive order that directed Commerce to report on semiconductor supply chain vulnerabilities, and the fiscal 2021 defense policy bill, H.R. 6395 (116), contained language creating a similar review.

Department of Justice

DIGITAL CRIMINALS SENTENCED — A federal judge on Friday sentenced two foreign nationals to prison for their roles in the cybercrime organization Infraud that caused more than $568 million in losses through stolen payment cards and identity theft. Sergey Medvedev of Russia, who received a ten-year prison term, and Marko Leopard of North Macedonia, who received five years, had pleaded guilty last year to a racketeering conspiracy.

Medvedev served as the criminal ring's administrator for several years, "handling day-to-day management, deciding membership, and meting out discipline to those who violated the enterprise's rules," according to the Justice Department. Leopard, meanwhile, acted as web host to Infraud members who wanted to sell contraband. The 31-year-old "hosted a number of sites for Infraud members in this fashion, providing the infrastructure that allowed his co-conspirators to profit off of their criminal activities," DOJ said.

Driving the Day

KT'S FIRST FULL WEEK: Shortly before midnight, USTR confirmed Tai "will begin virtual conversations with her international counterparts" this week, but provided no further details. She spent her first day on Friday meeting with USTR staff. That was a homecoming for Tai, who was the agency's chief China enforcement counsel before leaving in 2014 to become House Ways and Means Committee international trade counsel.

U.K. on deck: Tai is widely expected to talk with U.K. Trade Secretary Liz Truss as early as today about the U.K.'s interest in finishing talks on a bilateral free trade agreement.

What's less clear is what Tai will tell Truss, since time is running short for the two sides to reach a deal under the 2015 tranche of Trade Promotion Authority that expires at the end of June. In addition, the Biden administration has repeatedly said that it wants to invest in rebuilding the U.S. economy before pursuing any new trade agreements.

However, British officials believe a deal could be quickly wrapped up and have signalled their willingness to accept provisions in the area of labor and the environment that reflect the Biden administration's goal for a "worker-centered" trade policy that also addresses climate change.

Kenya calling: The Biden administration also must decide whether to pursue bilateral free trade talks with Kenya that were launched by the Trump administration. The two sides so far have held just two rounds of negotiations on the pact, which has been intended to become the model for other trade agreements with African countries.

EU concerns: EU officials are also eager to make contact with Tai to discuss the fate of former President Donald Trump's national security tariffs on steel and aluminum, as well as newly invigorated efforts to resolve the long-running Boeing-Airbus dispute.

No date yet for U.S.-China Trade Framework meeting: The acrimonious meeting in Alaska on Friday between top U.S. and Chinese diplomats provided further evidence that Trump's tariffs on more than $350 billion worth of Chinese are here to stay for a while, along with Beijing's retaliation on a proportional volume of U.S. exports.

Still, under the U.S.-China phase one deal, a bilateral "Trade Framework Group" consisting of the U.S. trade representative and a designated Chinese vice premier is required to meet every six months to discuss implementation of the pact. The agreement also requires regular meetings between the U.S. Treasury Secretary and a designated Chinese vice premier.

The last such meeting of the Trade Framework Group appears to have been a call between then-USTR Robert Lighthizer and Chinese Vice Premier Liu He on Aug. 24. That suggests the next one is already nearly one month overdue.

EU OUTLINES HOPES FOR WTO MINISTERIAL: The rules-based international trading system could fall apart over the next few years unless WTO members make progress soon on a package of new agreements and reforms, a senior European Union official said on Friday.

"If we do not succeed in reform of the WTO in the next three years, I think we risk having a very damaging fragmentation of the global trading system," Ignacio Garcia-Becerra said during a discussion hosted by the Peterson Institute for International Economics.

Appellate Body: Garcia-Becerra said the EU hopes to reach an agreement with the United States and other members on reforming the WTO's dispute settlement system by the group's 12th ministerial conference, which will be held in Geneva the week of Nov. 29.

The EU is willing to discuss the full scope of U.S. concerns about the Appellate Body, but any reform package must maintain the independence of the Appellate Body and continue to bar an individual member from blocking the adoption of a ruling, he said.

Garcia-Becerra stressed the need for a final deal to reduce or eliminate harmful fishing subsidies by MC12, as well as a resolution of the Covid-19 vaccine waiver debate being driven by South Africa and Brazil. The EU is very interested in exploring "the third way" approach suggested by WTO Director General Ngozi Okonjo-Iweala to resolve the impasse, he said.

Plurilaterals: The EU hopes to finish plurilateral negotiations on domestic services regulation by MC12 and to provide meaningful direction for other plurilateral negotiations on e-commerce and investment facilitation, he said.

In an initiative aimed primarily at China, the EU wants to relaunch talks with the U.S. and Japan on forging new rules to govern the use of industrial subsidies and bring in enough other like-minded countries over the next year that Beijing will be required to engage, he said.

Garcia-Becerra also cautioned that some badly needed reforms would take until MC13 to achieve. That ministerial will likely be held in late 2023.

FISHING SUBSIDY TALKS STILL DEEP IN DISAGREEMENT: The chair of the fishing subsidy negotiations, Colombian Ambassador Santiago Wills, told fellow ambassadors on Friday that countries disagree over the key issue of whether and how to excuse certain prohibited subsidies — such as for fuel or construction of boats — if a member demonstrates that it is taking measures to maintain healthy fish stocks.

Wills told the group some members believe the proposed text would make it difficult for developing countries to make use of the proposed exemption, while others say the same text is too permissive and creates a substantial loophole, a Geneva trade official said.

However, Will also noted some bright spots in the negotiation, including a willingness to make new proposals to improve the overfishing provisions, the Geneva official said.

RAIMONDO STEPS INTO 'PRIVACY SHIELD' TALKS: On the same day that Tai was sworn in, Commerce Secretary Gina Raimondo was digging into talks on transatlantic data flows for the first time with EU Justice Commissioner Didier Reynders.

The former Rhode Island governor said the two sides remain committed "to restoring certainty and predictability to transatlantic data flows," following a European Court of Justice ruling last year that struck down the "Privacy Shield" data transfer arrangement.

Reynders and Raimondo's predecessor, Wilbur Ross, began talks last year on a new pact to comply with the ruling.

AND BONES UP ON THE SEMICONDUCTOR SHORTAGE: On Friday, Raimondo met with senior executives from the Semiconductor Industry Association to discuss steps that could be taken to address the current shortage of chips and to boost U.S. production over the long term.

"Semiconductors are America's fourth largest export, and critical to our economic competitiveness and national security," she said in a statement after the meeting. "I believe we need to make strong investments in domestic manufacturing, research, and workforce, and help strengthen America's global leadership in semiconductor manufacturing and innovation."

BRAZIL TRIMS TARIFFS ON CAPITAL GOODS AND TECH PRODUCTS: Brazil announced last week that it is cutting tariffs on nearly 1,500 capital goods and information technology and telecommunications products by 10 percent. An import previously taxed at 16 percent would face a new duty of 14.4 percent as a result of the change.

Brazil's Special Secretary for Foreign Trade and International Affairs Roberto Fendt said the move would help reduce Brazilian production costs and is part of a broader trade opening agenda. Brazil and the three other members of Mercosur — Argentina, Paraguay and Uruguay — also are discussing changes to the common external tariff they impose on imports, former Brazil Foreign Trade Secretary Welber Barral told Weekly Trade.

REPORT DIGS INTO TECH COMPANY LOBBYING AT USTR: A new report from a technology watchdog group details a number of trade concerns that Facebook, Google, Apple and Amazon raised with USTR during the final months of the Trump administration.

Based on emails obtained under the Freedom of Information Act, the report from the Tech Transparency Project said Apple sought the help of USTR in dealing with multiple

issues in South Korea, including proposed legislation to establish new app store rules and an antitrust investigation by regulators.

The emails also showed Google asked USTR for assistance on another piece of South

Korean legislation in October-November 2020. Earlier in the year, Facebook sought USTR's aid on a piece of privacy legislation in Japan that it feared could hamper its Messenger texting service, the report said.

In another instance, USTR reached out to Amazon for advice on digital service taxes in India, Italy, Turkey and the U.K. in August-September 2020, the report said. Later, USTR formally determined that digital taxes in those countries "discriminate" against American companies.

Trade Remedy Corner

GOVERNMENT IN THE BEDROOM: The Commerce Department on Friday announced final anti-dumping duties on close to $400 million worth of mattresses from Cambodia, Indonesia, Malaysia, Serbia, Thailand, Turkey and Vietnam in a case brought by a coalition of U.S. producers and the United Steelworkers union.

The department also announced final countervailing duties on more than $160 million worth of mattress imports from China. Those are in addition to anti-dumping duties Commerce already imposed on Chinese-made mattresses in a previous case.

The U.S. International Trade Commission will vote by May 3 on whether to approve the latest set of duties.

The United States, Canada, Britain, and the European Union are set to announce an array of sanctions on China on Monday over what U.S. officials have called a genocidal campaign against Uyghur Muslims, according to two people familiar with the issue.

The sanctions are expected to vary in type, and will include Global Magnitsky economic sanctions on individuals alleged to be involved with the mistreatment of the Muslims in the Xinjiang region of China.

The EU this morning approved sanctions against four Chinese officials involved in the internment of hundreds of thousands of Uyghurs.

The coordinated campaign of sanctions comes as Secretary of State Antony Blinken is on his way to visit European officials in Brussels. Blinken was among the U.S. officials who held a tense meeting with top Chinese officials in Alaska last week.

A U.S. government official and another person familiar with the issue confirmed the plans. The State Department spokesperson did not respond to a request for comment.

1 big thing: Big Tech taps libertarian lifeline in D.C.

Tech companies bracing for increased scrutiny in Washington are leaning on their last friends in town — the libertarians, Axios' Margaret Harding McGill reports.

Why it matters: Progressive liberals and populist conservatives alike are ramping up their attacks on the tech industry. The once-beloved darlings of Silicon Valley are scrambling to gain traction on Capitol Hill with the dwindling ranks of Republicans who still believe in laissez-faire, even for the tech industry.

What's happening: Major tech companies have added prominent conservatives from the free-market world to their D.C. rosters in recent months.

  • Jesse Blumenthal is joining Apple after leading technology and innovation at Stand Together, an organization founded by Charles Koch.
  • Billy Easley, a senior policy analyst for the Koch-linked Americans for Prosperity who also worked on the U.S. Sentencing Commission, recently was hired by Reddit.
  • Mattie Duppler, an alum of the National Taxpayers Union and Americans for Tax Reform, joined Amazon last year.
  • Facebook and Google also have relied on veterans of free-market circles. Google hired Max Pappas, a former aide to Sen. Ted Cruz (R-Texas) in 2017, while Facebook tapped former R Street Institute outreach director Lori Moylan the same year.

Yes, but: The tech companies are also eager to hire Democrats as they seek to position themselves for the new administration and congressional majorities.

The big picture: The D.C. breed of libertarian who is against government intervention or regulation is fading fast among those in power in the Republican Party.

  • "I think you're seeing in part with the post-Trump right, a drifting away from the alliance with big business," said Zach Graves, head of public policy for the Lincoln Network, a conservative-leaning group focused on tech.
  • In Washington, tech has largely aligned with Democrats over the past decade. But with the tech-lash, free-market types are more natural allies given their opposition to regulation or government intervention.

Between the lines: The number of lawmakers — on either side of the aisle — who believe nothing should be done to regulate tech companies is dwindling, so the companies have their work cut out for them.

  • The lobbying strategy of sharing talking points with like-minded groups, who then author op-eds or blogs for company lobbyists to in turn share with lawmakers and staff as proof of support, isn't effective in this environment.
  • "The approach that tech companies have relied on for years — the justification for internet exceptionalism — is not influencing people on the Hill anymore," said Rachel Bovard, a former Senate aide now with the Conservative Partnership Institute.

2. Inside the Democrats' strategy to bombard Big Tech

The powerful Democrat overseeing antitrust legislation wants to hit Big Tech with the legislative equivalent of a swarm of drones rather than a single, hulking battleship that would be simpler to defeat, Axios' Jonathan Swan and Margaret report.

Driving the news: In an interview with Axios on Sunday, Rep. David Cicilline (D-R.I.) said he didn't want to give the major technology companies and their armies of lobbyists the easy target of a massive antitrust bill.

  • Instead, in his role running the House Judiciary Committee's antitrust panel, he plans to craft a series of smaller bills — perhaps 10 or more — that will be ready in May.

Why it matters: The way Cicilline sees it, this small-target strategy achieves two goals:

  1. He has a better chance of finding common ground between Democrats and Republicans on more narrowly targeted issues.
  2. And he makes it harder for Amazon, Facebook, Apple and Google to mobilize quickly against reforms they don't like.

Between the lines: "If you look at the way these technology companies have staffed up with their lobbying and the money they're investing in Washington, it's designed ... to prevent any changes to the current ecosystem that benefits them enormously," Cicilline told Axios.

  • "They have literally billions and billions and billions of reasons to try to protect the current system because it produces ... profits not seen on planet Earth."
  • Recognizing this reality, Cicilline said his intention is to use this range of bills to advance all the recommendations in his panel's 450-page investigation into competition in the digital marketplace.

Big picture: "My strategy is you'll see a number of bills introduced, both because it's harder for (the tech companies) to manage and oppose, you know, 10 bills as opposed to one," Cicilline said.

  • "It also is an opportunity for members of the committee who have expressed a real interest or enthusiasm about a particular issue, to sort of take that on and champion it."

Behind the scenes: Outside of his antitrust work, Cicilline also is readying a proposal taking aim at online companies' key protection against liability from users' posts, Section 230 of the Communications Decency Act.

  • Cicilline said his proposal, which is in the early stages, would focus on the decisions companies like Facebook make to amplify content that's posted by users.
  • "That's a very complicated algorithm that is designed to maximize engagement to drive up advertising prices to produce greater profits for the company," Cicilline said. "That whole set of decisions, one could argue, is different than the initial post. That's a set of business decisions for which, it might be quite easy to argue, that a company should be liable for."

The bottom line: Cicilline says he is optimistic the Biden administration will be a partner in the work on antitrust, and that tech companies are wrong if they think the pandemic has brought them a reprieve from government action.

  • "Frankly, the pandemic in many ways made the market dominance of these technologies companies even greater and has demonstrated the monopoly power they have," Cicilline said.

3. Tim Cook, other Apple execs to testify in Epic trial

Apple CEO Tim Cook and other top Apple executives are expected to be among the witnesses when a trial begins in the company's legal battle with Fortnite creator Epic Games, according to an initial witness list Apple released late Friday.

Why it matters: The lawsuit is with Epic, but at stake is Apple's way of doing business in the App Store, including its 30% cut and requirement that developers use only Apple's in-app payment system for digital goods.

Details:

  • Among Apple's witnesses are Cook, software chief Craig Federighi, and longtime marketing chief and current Apple fellow Phil Schiller,
  • Epic CEO Tim Sweeney is also expected to testify, along with operating chief Daniel Vogel and marketing VP Matthew Weissinger.
  • The trial is set to begin May 3 in federal court in Northern California.

Between the lines: Expect more fireworks as the trial draws closer and each side reveals information learned through discovery.

  • For Apple, which tends to like to keep nearly everything confidential, lawsuits often provide a unique window into the company's day-to-day operations, as was the case during its years-long battle with Samsung.

4. Charted: The slow trudge back to the office

Analysis and forecast for GBP/USD on March 22, 2021

In today's review of the pound/dollar currency pair, we will again touch on the topic of COVID-19, summarize the results of the trading week that has ended, and try to assess the prospects for GBP/USD in the light of the current five-day period. So, universal vaccination against coronavirus is still the most important component to prevent the further spread of COVID-19. At the same time, as it turns out, of many strains of coronavirus infection, virologists consider the "British strain" to be the most dangerous. It accounts for a total of 60 to 80 percent of all infections. At the same time, the "British strain" is considered the most resistant, and not all types of vaccines can counteract it. As for the vaccination itself, in contrast to the European Union, it takes place at a much faster pace in the UK. According to media reports, about 900,000 Britons have been vaccinated in the United Kingdom over the past 24 hours. Needless to say, the indicator is quite impressive.

If we go back to the results of last week, then, as already noted in today's article on EUR/USD, all major currencies, except for the Japanese yen, showed a downward trend against the US dollar. In particular, the British pound fell by 0.34% at the auction on March 15-19. These losses can not be considered significant and this is visible on the weekly chart. There is an important point that can not be ignored. We are talking about the mark of 1.4000, where a very strong resistance of sellers is concentrated. As you can see, for three weeks in a row, the bulls fought for the pound to go up. This is a significant psychological and technical level, however, they did not manage to implement their plans.

It would seem that, after the appearance of the circled reversal candle, the "British" expects a downward trend, but below 1.3777, the bears did not manage to continue the decline in the pair. So it turns out that the range in which GBP/USD is traded can be designated as 1.4004-1.3777. In the author's personal opinion, only a true exit from this created price corridor can signal the further direction of the British currency in pair with the US dollar. It is characteristic that approximately in the middle of this range, there is a red line of the Ichimoku Tenkan indicator, around which the pair barrages. At the same time, the support at 1.3777 is strengthened by the lower border of the ascending channel, and the no less significant level of 1.3700 is slightly lower, so to demonstrate the seriousness of their intentions, players need to bring the price down from the channel and lower it below the mark of 1.3700. The bulls have their tasks, the main one at the moment is the breakdown of the strong psychological and technical level of 1.4000. If this task is eventually solved, the pair will head to another important and strong resistance of sellers, which is held in the area of 1.4230. These are the prospects for GBP/USD, judging by the weekly timeframe.

On the daily chart of the pound/dollar pair, we see that today's trading opened with a small price gap down, after which there are attempts to close the gap. Another detail that is worth paying attention to is the middle line of the ascending channel (dotted), which provides the quote with quite strong support and does not allow the rate to gain a foothold below. However, even going under the middle line can limit the strong support zone of 1.3800-1.3777, where the minimum trading values were shown on March 16 and 3, respectively. As for the resistance, the nearest of them is represented by the red Tenkan line of the Ichimoku indicator, which lies at a significant level of 1.3900. Given the ambiguous technical picture on the two timeframes considered, there are both purchases and sales of the GBP/USD pair. It is worth looking at the nearest sales near the mark of 1.3900, and higher on the approach to the levels of 1.3940, 1.3980, and 1.4000. Purchases of the British currency should be considered from the price support zone of 1.3805-1.3780. You can try to buy from the current prices, but with small goals, near 1.3905. In tomorrow's article, we will look at smaller time intervals, and, if necessary, we will make changes to today's recommendations for GBP/USD.

Euro and pound sagged last Friday when the yield on 10-year US bonds increased again.

But in the afternoon, balance returned in the market because Treasuries retreated after jumping noticeably in the morning. Aside from that, demand for the US dollar remained relatively low due to the lack of important economic data from the United States.

Today though, EUR / USD is still under the control of the bears because the market opened with a small but noticeable gap downwards. This suggests that a consolidation below 1.1875 will push the price down even lower, perhaps towards 1.1835 and 1.1790. But if the bulls manage to bring the quote back to 1.1935, EUR / USD could climb towards the 20th figure, where a break above could lead to a further increase towards 1.2050 and 1.2110.

On a different note, Reuters revealed that Europeans have become less confident in AstraZeneca's COVID-19 vaccine. This is mainly due to news of complications from its use.

Confidence fell most strongly in France and Germany, followed by Italy and Spain. More specifically, the poll indicated that around 55% of Germans and 61% of French respondents consider AstraZeneca to be unsafe. Meanwhile, 36% of Italians and 38% of Spanish respondents view the drug as risky.

The survey is based on recent rumors that the AstraZeneca vaccine caused blood clots in the brain after its use. But the European Medicines Agency (EMA) said the drug is safe and effective, and was not associated with venous sinus thrombosis.

Europeans don't have many options for vaccine. Therefore, if they abandon AstraZeneca, it would seriously impact the bloc's rate of vaccination, which would accordingly lead to the delay of the lifting of quarantine restrictions. Such would also affect the rate of economic growth this year.

As for the United States, immunization is more advanced, thanks to the recently-approved $ 1.9 trillion stimulus bill. With it, Americans are also given additional checks worth $ 1,400, which helps not only the population, but also the US economy.

Last week, European Central Bank President Christine Lagarde also addressed the issue on additional financial stimulus. She warned lawmakers about the risks of a slow rollout of the € 750 billion EU recovery fund, and said that the actions of the ECB alone are not enough for an effective economic recovery. Therefore, there is a need for further monetary and fiscal support.

Going back to vaccinations, the European Union is reported to be planning a ban on exports of COVID-19 vaccines. Apparently, they are tired of asking for more supply, so they decided to take action. A senior official said the European Commission will discuss the move this week, and will most likely impose the ban until AstraZeneca fulfills its obligations to EU countries. Of course, this would seriously affect the relations between Europe and the UK, but Brussels is obviously set on banning vaccine exports to London until the bloc receives enough supply.

With regards to macro statistics, reports from Germany, although very positive, did not lead in a strong rise in EUR / USD. Nevertheless, PPI increased for three consecutive months, jumping by 1.9% year-on-year in February 2021. The core non-energy index also rose by 1.4%, while energy prices climbed by 3.7%.

As for Italy, reports reveal that construction volume rose 4.5% this January, after a massive 4.2% fall last December. Then, on a yearly basis, it decreased by 1.5%.

GBP / USD

Pound continues to trade downwards and is now one step away from forming a strong bearish trend. Obviously, bulls are very weak, but they need to try preventing the breakdown of the 38th figure. This is because dropping below the level will result in a strong collapse towards 1.3740 and 1.3680, which will begin the bear market. But if the bulls manage to bring the pound back to 1.3800, then most likely GBP / USD will climb again to 1.4000.

With regards to macro statistics, a report revealed that fiscal deficit in the UK hit its highest level this February, reaching a massive £ 19.1 billion from £ 17.6 billion a month earlier. In a yearly basis, it widened sharply from £ 228.2 billion to £ 278.8 billion.

The previous week has maintained its uncertainty character, with the most important support and resistance levels in this area continuing to be located at the previous borders. The pair remained within the range of 1.1975-91 (weekly Kijun + daily Fibo Kijun) - 1.1886 (weekly Fibo Kijun). If it moves further below, it will be possible to test the downward targets of 1.1821 - 1.1762 (daily target for cloud breakout + monthly short-term trend). In turn, the upward movement will lead the Euro currency to the daily and weekly cross levels (1.2039-64), followed by the daily cloud.

The key levels in the smaller time frames continue to serve as resistances, currently located in the area of 1.1905-20 (central pivot level + weekly long-term trend). However, the favor remains on the bearish side. Today, the downward targets are set at 1.1873-1.1842-1.1810 (classic pivot levels). We can note that the correction period, as well as the proximity and influence of the attraction zone of the key H1 levels, weaken the bears. So, if the price consolidates above the range of 1.1905-20, this will allow us to consider strengthening the positions and moods of the bulls.

The weekly candlestick retained its uncertainty. But based on the current result, some advantage still persists on the bears' side, as they successfully close the week below all the closest attraction and resistance levels. The next downside target is now the daily cloud, strengthened by the weekly Fibo Kijun (1.3672). Meanwhile, the resistance and attraction levels retain their position and still form their influence in a fairly wide area 1.3904-1.3954-1.4008-1.4062 (daily cross + weekly levels).

The key advantage in the smaller time frames still belongs to bearish traders. In fact, the pound sterling is currently in the upward correction zone after testing the first support (1.3815) of the classic pivot levels. Once this support level is broken, the path will open towards other support levels at 1.3759 (S2) and 1.3687 (S3).

Alternatively, the development of a correction and consolidation above the key levels of 1.3901- 1.3887 (central pivot level + weekly long-term trend) will change the current situation. If this happens, the resistance levels of the classic pivot levels (1.3943-1.4015-1.4071) will become relevant again.

Ichimoku Kinko Hyo (9.26.52) and Kijun-sen levels in the higher time frames, as well as classic Pivot Points and Moving Average (120) on the H1 chart are used in the technical analysis of the trading instruments.

The price from the level of 1.1903 (closing of the last weekly candle) is expected to continue declining to the historical support level of 1.1777 (blue dotted line) this week. After reaching this level, the downward movement may resume towards a target of 1.1693 (red dotted line) – a pullback level of 38.2%.

A downward movement can be concluded based on comprehensive analysis.

The overall result of the candlestick calculation based on the weekly chart: the price will most likely move in a downward trend, both without an upper shadow (Monday - down) and lower shadow (Friday - down) in the weekly black candlestick.

Analyzing the current trading chart of Gold, I found that the buyers got exhausted today and the downside roattion would be probably to correct strong upside movement from recent few days.

Based on the 4H time-frame , there is completion of the ABC upside correction and potential for the another downside swing.

Additionally, there is the breakout of the upside channel, which is good confirmation for the downside...

Key Levels:

Resistance: $1,748

Support levels: $1,701 and $1,679

Last week, the pound/dollar pair declined, tested the level of 1.3829 (blue thin line) – 8th average EMA and then rose, testing the upper fractal of 1.4003 (weekly candlestick from 03/07/2021). The market closed the weekly candle at the level of 1.3972. This week, the price will most likely continue its downward trend.

Trend analysis

This week, the price from the level of 1.3972 (closing of the last weekly candle) is expected to decline to the target of 1.3737 (white thick line) – the support line. After testing this line, it may rise to the target of 1.3942 (blue dotted line) – a pullback level of 85.4%.

The first downward target is the support line of 1.3737 (white thick line). After testing this level, the price may rise to the target of 1.3942 (blue dotted line) – a pullback level of 85.4%.

As an alternative, the price from the level of 1.3972 (closing of the last weekly candle) may decline to the target of 1.3942 (blue dotted line) – a pullback level of 85.4%. Once this level is tested, the upward trend may resume to the target of 1.4237 (blue dotted line) – the historical resistance level.

BOJ purchases £50.1 billion worth of ETFs today

BOJ kicks off its new ETF policy with a £50.1 billion purchase today

That's the third time this month and the fourth time (all same amounts) this year.

The latest purchase today comes amid a 2% drop in the Nikkei and a 1% drop in the Topix. The latter is the focus of the latest shift in BOJ policy but if anything, it just rather shifts the support away from less growth-heavy stocks to more value-heavy stocks.

Analyzing the current trading chart of EUR/USD, I found that buyers are in control today but that there is strong resistance at the price of 1,1935.

Based on the 4H time-frame , my advie is to watch for potential test of strong resistance and try to play for the downside towards the 1,1880.

EUR / USD closed with a pin bar last Friday, around which sellers have been accumulating stop losses for two weeks (behind 1.9900 and 1.2000).

Taking this into account, the most profitable transaction would be buy positions, the strategy for which is presented below:

Since the euro formed an ABC pattern, where wave A is the bullish initiative last Friday, traders can open long positions in order to set off a 50% retracement from 1.19.

Place limit at 1.18800, and then take profit as soon as the quote reaches 1.9900-1.2000.

Of course, risks should be monitored to avoid losing money. Trading is very precarious, but profitable as long as the strategy used is correct.

The plan above follows the classic Price Action and Stop Hunting methods.

  • Also, the daily resistance and support are seen at the levels of 1.3982 and 1.3821 respectively.
  • Therefore, it is recommended to be cautious while placing orders in this area. So, we need to wait until the sideways channel has completed.
  • The market moved from its bottom at 1.3821 and continued to rise towards the top of 1.3982.
  • Today, in the one-hour chart, the current rise will remain within a framework of correction.
  • However, if the pair fails to pass through the level of 1.3982, the market will indicate a bearish opportunity below the strong resistance level of 1.3982 (the level of 1.3982 coincides with the double top too, 61.8 of Fibonacci - golden ratio).
  • Since there is nothing new in this market, it is not bullish yet. Sell deals are recommended below the level of 1.3982 with the first target at 1.3821.
  • If the trend breaks the support level of 1.3821, the pair is likely to move downwards continuing the development of a bearish trend to the level 1.3724 in order to test the daily support 2 (horizontal red line).

THE BUZZ — Will another Democrat run in the recall?

It's a question that's preoccupying California's political class these days. Depending who you ask, putting another Democrat on the ballot is either an indispensable insurance policy or an inexcusable breach of unity. Whatever your opinion, a certain profile seems ideally suited. The candidate would have name recognition and a preexisting political network that could be activated to raise funds. They would be rooted in Southern California. They might not currently hold office, and thus would have less to lose.

TONY V'S TIME? — That description might remind a lot of people of former Los Angeles Mayor Antonio Villaraigosa, Gov. Gavin Newsom's Democratic opponent in the 2018 gubernatorial primary. Villaraigosa stoked a storm of speculation on Friday with some pointed tweets saying California must "open up our schools now." The former mayor has been vocal on education issues — which were a dividing line in the 2018 contest, as charter allies took a mighty swing-and-a-miss by spending big for Villaraigosa and against the union-backed Newsom. Closed schools have been one of Newsom's principal political liabilities.

Not long after those tweets set California politics-land abuzz, we heard from former Assembly Speaker and close Villaraigosa ally Fabian Núñez. He wanted to underscore that he is firmly in Newsom's camp and predicted that "at the end of the day, all of the Democratic establishment and Democratic activists are going to be on the side of Gov. Gavin Newsom," because "you're either with Gov. Gavin Newsom or you're with the pro-Trumpers who are trying to push him out of office."

The 2003 recall naturally influences how everyone is gaming out the 2003 version. And no one wants to be Cruz Bustamante , the then-lieutenant governor who was consigned to political oblivion after running as the Democratic backup to doomed Gov. Gray Davis. "We can't make the same mistake twice," Núñez told us, bringing up Bustamante before adding, "I don't see Democrats repeating that exercise again. I just don't see a strong Democrat running." Núñez stressed that he does not speak for Villaraigosa and declined to get into private conversations, but he predicted "there will be no Democrat of consequence on that ballot."

BOTTOM LINE: Newsom is in a far more solid position than Davis was. The sense out there is that any Democrat seriously contemplating a run will wait and see how the governor's poll numbers look closer to the filing deadline. While California is on an upward trajectory out of pandemic prison, you never know what might happen between now and September. But the risks would be high. As Newsom campaign hand Sean Clegg tweeted on Friday: "My old friend Antonio will embarrass himself and forever poison his legacy if he runs."
