THE BUZZ — GRAY'S BEEN THERE: Gray Davis has some comforting advice for Gavin Newsom in the final 48 hours of the California recall election — no, 2021 will not be 2003.

The biggest difference: "In my day, the Democratic and Republican parties were pretty evenly divided,'' the former California governor — the only state governor to be recalled in history — tells Carla in an interview. "There has been a massive shift to Democrats over the past 18 years. Today they're about 5 million more Democrats than Republicans."

But Davis — ousted in the 2003 recall that brought Arnold Schwarzenegger to power— warns that there is a big problem lurking in California's political system. And that's the quirky rules that have made two pricey California gubernatorial recalls possible in less than two decades. The recall system, he predicts — "mark my words" — will deliver a dangerous blow to democracy if not reformed.

"This is a game of Russian roulette,'' Davis says. "And at some point, for sure, a governor who got more votes than his successor will have to leave office — because he failed to reach the 50 percent threshold." Read more from Carla's interview here.

WILL CA WOMEN SAVE NEWSOM? POLITICO's Mackenzie Mays reports on a key trend heading into Election Day: Newsom could have women to thank if he fends off the recall on Tuesday. A striking gender divide has crystalized in the lead-up to the election, with a new poll showing 66 percent of women voters plan to reject Newsom's ouster. Meanwhile, a razor-thin majority of men say they'd vote to recall him.

Newsom, a self-proclaimed feminist and father of four, has made a habit of speaking directly to women — particularly mothers — as he embraces policies from mask mandates in schools to expanded family leave. Read Mackenzie's full story here.

SPEAKING OF WOMEN... ELDER TOUTS MCGOWAN'S BACKING: Republican gubernatorial candidate Larry Elder on Sunday accepted an endorsement from actress Rose McGowan, who made news in 2017 with accusations of rape against Harvey Weinstein . The endorsement came just days after McGowan alleged that Newsom's wife, Jennifer Siebel Newsom, contacted her on behalf of the Hollywood producer's law firm in an attempt to silence her #MeToo allegations.

Emails shared by McGowan with POLITICO show Siebel Newsom was in touch with McGowan in 2017 — but don't directly confirm McGowan's claim. In a December 2017 message that Siebel Newsom characterizes as being to an "email list of Harvey victims," the governor's wife wrote that "an extended family member" works for the law firm of David Boies , Weinstein's attorney. While Siebel Newsom characterized Boies' actions as "sickening," she said had reached out to McGowan as an intermediary, hoping to learn "what if anything Boies could do for her that would help her to heal," which Newsom could have conveyed "to my brother in law to take to Boies." (That's a reference to Joshua Schiller, the husband of Siebel Newsom's sister and a partner at Boies Schiller Flexner.)

McGowan asserted in a message to POLITICO that Siebel Newsom had spoken in a call preceding the email not of healing but of the law firm wanting to know "what would make you happy" — phrasing that wasn't reflected in the emails she provided.

A representative for Siebel Newsom called McGowan's allegations "a complete fabrication," saying, "Their limited correspondence has been strictly as fellow survivors of sexual assault and in Jennifer's former capacity leading the Representation Project, an organization that fights limiting gender stereotypes and norms."

AND THERE'S THIS… Siebel Newsom, in a 2017 op-ed in the Huffington Post, defended Weinstein's accusers, saying "I believe every word that was written in the New York Times, because very similar things happened to me." She wrote: "Let this really be the end of Harvey Weinstein and the Weinstein's of the world― no matter their wealth, no matter their power, no matter their privilege. Because the Harveys of the world will do whatever it takes to put up a fight and silence their victims, intimidate them from coming forward."

LONG BEACH, THE FINAL AND SYMBOLIC STOP: Biden's trip to Long Beach Monday takes him to the California city that was the vanguard on moves to shut down Covid — a city whose mayor, Robert Garcia , has felt the devastating effects of the pandemic, having lost both parents to Covid. "He called and personally reached out to me, and shared his own experiences, talking about the losses he's had,'' Garcia said. "And it means a lot."

Garcia, in an interview with POLITICO, said "the president has called our city a national model ... because we really stepped out early and did things that other jurisdictions weren't doing.'' He said his office was in touch with the White House. FINAL 48 HOURS — "Recall poll shows Newsom in strong position to survive," by POLITICO's Nick Niedzwiadek: Roughly 60 percent of likely voters polled said they opposed recalling Newsom, compared to 38.5 percent who supported removing Newsom and filling his term with someone else. Only 1.4 percent of respondents said they had yet to make up their minds, a sign that Republicans may have a difficult time unlocking significant last-minute momentum ahead of the Sept. 14 contest.

FIRST IN PLAYBOOK — SCHIFF's MONEYBALL FOR GAVIN: Rep. Adam Schiff, a top Democratic House fundraising rainmaker, tells POLITICO that "when I asked my supporters to defeat the recall, we were able to raise almost $500,000.''

Schiff says that windfall underscores what energized Democrats in the closing weeks: "The reality is, Californians understand that this recall is a costly stunt by Republicans who can't win in a general election and can buy their way onto the ballot.'' So, Schiff says: "We not only want to defeat it — we want to defeat it soundly."

THE BIG PICTURE — " Democrats try to put Trump on the ballot in California, Virginia and New Jersey races.'' via Washington Post's Dave Weigel, Colby Itkowitz and Gregory S. Schneider: " California is one of three Democratic-led states — the others are Virginia and New Jersey — holding statewide elections this year. In each state, party leaders acknowledge that in past elections Trump polarized and motivated voters that they had never won before his presidency. Democrats worried that his absence from the ballot, along with their party's historic difficulties in turning voters out in non-presidential elections, would threaten their chances."

HOW THE ATLANTIC SEES IT — " What Is Larry Elder Running For?" by the Atlantic's Annie Lowrey: "The brief, strange political career of the man who leads the Republican pack in the California recall election."

BIG LIE REDUX? — "Newsom slams Elder for 'extension of the Big Lie' ahead of California recall,'' by POLITICO's Colby Bermel: Elder recently added a section to his campaign website with the option "report election incident," which takes users to a separate 'stop California fraud' website. He has also threatened a lawsuit. Other conservative Republicans have begun to cast aspersions on California's election process without providing evidence, including former President Donald Trump, who told Newsmax that Tuesday's contest is "probably rigged."

INCIDENT EXAMINED — " Police seek woman in Larry Elder attack as his supporters claim a double standard," by LATimes' Julia Wick, Richard Winton and Joe Mozingo.

THE BIG ISSUE — "Where the recall candidates stand — and sidestep — on healthcare policy," by LATimes' Samantha Young and Rachel Bluth: "Exactly where all the leading Republican recall candidates stand on healthcare is unclear. Other than vowing to undo state worker vaccine mandates and mask requirements in schools, none have released comprehensive healthcare agendas."

CALIFORNIA AND THE CAPITOL CORRIDOR

END OF SESSION UPDATE: We told you going into the final day of the legislative session that it was looking unusually quiet , but we were still astonished to see both houses adjourn by 9 p.m. — the earliest conclusion that most people can remember, and a stark break from the chaos of the last two years.

We still saw some high-profile bills perish: the most prominent remaining environmental bill collapsed in the Senate; an effort to bar prisons and jails from releasing immigrant detainees to ICE never got a Senate floor vote; and an expansion of automatic records expungement fell short on the Assembly floor after another of its author's bills was the object of some inter-house machinations.

Onward to Newsom went measures to end mandatory minimum drug sentences, to extend and expedite California's aid-in-dying law and to ensure journalists can cover protests. A bill to decriminalize loitering with the intent to commit prostitution passed but, in an unusual request, Sen. Scott Wiener is buying more time to convince Newsom by waiting to send it to the governor until January.

Legislative leaders insisted the looming recall vote didn't affect which bills made it, arguing they pursued ambitious legislation regardless. But they're confident they won't be working with a new governor any time soon. "When we get back in January, Gavin Newsom will still be governor," Speaker Anthony Rendon said after votes concluded. "I have complete faith in the voters of California they won't buy into this power grab."

UM, WUT? — " California Senate passes bill allowing state to keep details of COVID outbreaks secret," by Bay Area News Group's Fiona Kelliher: "AB 654 was revised days before the end of the legislative session Friday to erase a requirement that the California Department of Public Health publicize COVID outbreaks by location, contradicting the author's stated purpose in drafting the bill and dealing a blow to employees, advocates and epidemiologists who have long argued that such information is essential to protecting workers."

SWAB SCENE — "Unvaccinated California state workers to take COVID tests under eye of their managers," by SacBee's Wes Venteicher: "Under California Public Health Department guidelines, unvaccinated employees would take their own nasal swabs in the presence of a supervisor and then hand over the sample. The supervisor would roll the swab in reagent solution on a testing card, and wait about 15 minutes for a result."

TAHOE BLUE — "One Of California's Favorite Escapes May Never Be The Same Because Of Climate Change," by Buzzfeed News' Stephanie K. Baer and Brianna Sacks: "As of Friday, no one was killed in the blaze and officials believe not a single home in the Lake Tahoe Basin was destroyed. However, the fire, which was 53% contained, had so far consumed more than 218,000 acres and burned down 782 homes elsewhere."

— "COVID jobs recovery: California rebound is among nation's worst," by Bay Area News Group's George Avalos: "Through the end of July, California had recovered slightly more than 58% of the 2.71 million jobs it lost during March and April of 2020, leaving a deficit of 1.13 million jobs."

NOT SO FAST — " Other school districts in no rush to follow Los Angeles Unified vaccine mandate," by CalMatters' Joe Hong: "While Los Angeles Unified became the first major district in the nation to issue a vaccine mandate for all eligible students, other school districts are in a holding pattern."

— "Thanks To This Woman's College Paper, "Stealthing" Could Soon Be Outlawed In California ," by Buzzfeed News' Tasneem Nashrulla: "California lawmakers have sent the governor a bill that would allow victims of 'stealthing' to sue partners who secretly remove condoms during sex."

SB 524 raises health care costs by eliminating the tools health plans, employers, unions, and the state use to lower the cost of health insurance and prescription drugs. It places harmful restrictions on how employers and unions design pharmacy benefit plans to lower prescription drug costs—instead of letting them create the individual high-quality, affordable plans that keep their costs low and help their employees and members pay less at the pharmacy counter.

Most alarmingly, it puts California's most vulnerable patients at risk by undermining all the important safety and quality requirements for pharmacies that handle specialty medications.

1 big thing: Ad wars intensify as Democrats' plans take shape

Environmentalists and industry groups are launching fresh media buys as congressional Democrats craft plans to expand green energy incentives and spending while imposing new or higher fees on oil companies, Ben writes.

Driving the news: The League of Conservation and Climate Power has begun $6 million in new TV and digital ad spending that try to bolster four Senate Democrats and around 20 House members.

  • The ads (like this one) aim to show that Democrats supporting the plans, several in competitive districts or states, help boost jobs and cut pollution.
  • Separately, the American Clean Power Association — a renewables and battery storage industry group — this morning announced the next phase of its ad campaign with TV and digital spots in seven states and Washington, D.C., that together cost seven figures.
  • The American Petroleum Institute (API) is beginning the latest installment of its own seven-figure campaign. The industry group is fighting plans it says will erode U.S. energy security and raise costs, including a new fee on methane emissions and repeal of longstanding tax deductions.

The big picture: The latest ads arrive amid wider advocacy battles and efforts to sway politically vulnerable lawmakers as Democrats look to move a multitrillion-dollar package of major health care, social safety net, and energy and climate measures.

  • It is, as Bloomberg notes, a "lobbying frenzy" as key votes loom in coming weeks. The contours of Democrats' plans will come into greater focus this week with votes in multiple House committees.
  • The political path this fall is extremely fraught as Democrats look to move the package on razor-thin party-line votes in concert with the smaller bipartisan infrastructure package.
  • But Politico has some interesting reporting on how liberal interest groups have been more than holding their own in recent weeks in the ad wars over the Democratic legislation.

Why it matters: Energy pieces of the Democrats' brewing legislation — and to a lesser degree the bipartisan plan — are vital to the White House goal of cutting U.S. greenhouse gas emissions in half by 2030.

The fate of the effort will influence the success or failure of a critical United Nations climate summit this fall.

Zoom in: The new, jobs-focused American Clean Power Association TV ads backing the two bills are launching in seven states including West Virginia and Arizona.

Sens. Joe Manchin (D-W.Va.) and Kyrsten Sinema (D-Ariz.) likely hold the fate of the Democrats' efforts in their hands, and the ads say the legislation will create jobs in their states.

One reason the path is so dicey is that Manchin has signaled he'll only support a much smaller price tag for the overall bill.

The other side: The latest API ads look to rally opposition in Pennsylvania and Arizona to the Democratic legislation.

This ad looks to sway Rep. Tom O'Halleran, a swing district Democrat in Arizona. "As prices on everything rise, politicians D.C. want to increase the cost of American-made energy," it states.

2. The stakes of John Kerry's trip to India

Special Climate Envoy John Kerry is in India to try to bolster bilateral and multilateral efforts ahead of the critical U.N. climate summit this fall, Ben writes.

Driving the news: The State Department said Kerry will meet with government and private sector officials to "raise global climate ambition and speed India's clean energy transition."

Why it matters: India's carbon emissions have climbed a lot this century (see chart above) and energy demand will keep rising.

3. House Dems lay down their clean energy marker

A lot of info surfaced since our last edition about what House Democrats want to include in the multitrillion-dollar budget reconciliation plan they hope to move on a party-line vote, Ben writes.

Driving the news: House Ways and Means Committee Democrats dropped the 645-page draft Friday night and it's stuffed with energy and climate provisions.

Some takeaways...

1. It's a mix of new and old. The package extends key renewable power tax incentives into the early 2030s before they phase down. But it tweaks those in several ways.

  • That included domestic content requirements, a bid for union support via higher credits for projects that pay prevailing wages, and new incentives for solar projects in low-income communities.
  • It also would add several new incentives, such as one aimed at continuing the operation of existing nuclear plants and another for "clean" hydrogen.
  • There's also a new credit for homes and businesses to cut wildfire exposure.
  • There are also expanded incentives for carbon capture and removal, including provisions to boost nascent direct air capture tech deployment.

2. It goes big on EVs, but there's drama already: The plan would hugely expand consumer electric vehicle purchase incentives, but with a catch.

  • The maximum credit is now up to $12,500 (it's currently $7,500), but nearly all of the extra incentive only applies to union-made cars, which helps Detroit automakers.
  • Toyota, in a statement, said it discriminates against non-union workers, and via Reuters, Honda has similar complaints.
  • Beyond that, the plan also removes the per-manufacturer cap of 200,000 vehicles that can receive the full EV credit. This would help both Tesla and General Motors, which have already reached the limit.

3. It's written in pencil: Ways and Means is marking up the bill this week. But equally (if not more) importantly, the bigger question is what happens in the Senate, where the wider reconciliation package requires support from every Democrat.

4. A new residential solar push with a justice focus

A broad coalition is pushing Congress to make a key residential solar incentive more available to the low-income and communities of color, Ben writes.

Driving the news: Residential Renewables for All brings together around 350 organizations and individual advocates, including environmental groups, civil rights organizations and renewables companies.

  • The ad-hoc coalition is formally launching today (although it quietly began in August).
  • It includes the National Wildlife Federation (NWF), the NAACP, the Union of Concerned Scientists and Black Owners of Solar Services.

How it works: They want revision a longstanding tax credit for installing home solar systems and some other clean energy tech.

  • Right now the credit doesn't help low-income people with limited or no tax liabilities, or who cannot wait years, under the current structure, to monetize the value.
  • The group wants the credit available as an upfront "direct pay" incentive available regardless of tax liability.
  • They estimate that 26 million households, including a combined 6.2 million Black and Latino households, "are unable to benefit...because they do not have sufficient taxable income."

What they're saying: NWF's Mustafa Santiago Ali tells Axios it's one of the ways vulnerable communities can move from "surviving to thriving" by fighting pollution, lowering energy bills, and giving people more control over energy choices.

"When we have these types of initiatives in place, giving people the opportunity to have energy democracy, giving people the opportunity to play an active role in the lessening of the impacts and breaking our addiction to fossil fuels, then we have a triple-win situation," Ali says.

What's next: Starting this week the group's members will ramp up outreach to lawmakers. They're also working with the Solar Energy Industries Association, a spokesperson said.

5. Tropical Storm Nicholas forms and heads for Texas

Tropical Storm Nicholas formed Sunday in the southwestern Gulf of Mexico and is forecast to make landfall Monday afternoon as either a strong tropical storm or Category 1 hurricane, Andrew writes.

Why it matters: The storm's main threats are heavy rains and storm surge flooding. Surge could reach as high as 3 to 5 feet above the normally dry ground near where the storm moves ashore.

  • Forecasts call for between 8 to 16 inches to fall from Corpus Christi north into Houston-Galveston — areas that are both major energy hubs — and then spreading into Louisiana.
  • A few 20-inch amounts are possible, the National Hurricane Center warns. There is a "high" risk outlook of flash flooding for the Texas coast between Corpus Christi and Houston Monday.

Context: Tropical storms and hurricanes are producing more rainfall as sea and air temperatures increase with global warming. For every 1°C increase in temperature, the air can carry about 7% more water vapor, providing more energy to storms.

Details: If any refineries are temporarily taken out of service, it could affect gas prices since there are still outages in the wake of Category 4 Hurricane Ida, which hit Louisiana earlier this month.

  • As of Friday, three Louisiana refineries were still shut, accounting for about 4% of U.S. refining capacity, while as of yesterday about half of Gulf of Mexico offshore oil-and-gas production was offline.

Welcome back to another week of trading!

It's a big week ahead, and we're coming off five straight days of down markets.

Could this be the beginning of a significant reversal?

We can't know yet, but two big economic reports this week could have an effect…

In the upcoming week, we have two big economic reports to monitor.

First, the Consumer Price Index, or CPI.

The CPI is one of our best measures of inflation, and last month's number showed a huge 8.3 percent spike year-over-year.

Analysts are expecting a calmer number this month, but another big number could be very worrying.

A higher-than-expected CPI could spark talk about the Fed changing policy, including raising its rates, which would be bad news for the markets.

We've seen big selloffs at even the mention of the Fed raising its rates in the recent past, so we'll want to watch CPI carefully to see if it sets off that chain reaction again.

The other big number, coming Thursday, is retail sales.

This will show us a lot about the health of the economy.

If retails sales are strong, then some of the concerns about inflation and especially about a slowing economy could be settled.

But if CPI is high and retail sales are low, it will point to (whether fairly or unfairly), the dreaded "s" word: stagflation.

Stagflation occurs when inflation is rising but the economy isn't improving and unemployment is high.

Some analysts believe that isn't really the case right now, but if these reports go in opposite directions, the market is likely to react poorly, whether it's a fair indication of reality or not.

So, as you're going through the week, watch carefully for CPI on Tuesday and retail sales on Thursday.

They'll be very important numbers for how the market responds this week.

Senate President Don Harmon will be voting yes on the clean-energy legislation that's headed to his chamber today for a vote in Springfield after the House passed a version last week with bipartisan support and a nod from the governor.

Senate passage is critical as Exelon has set today as the deadline to decide on closing its Byron nuclear plant. Without funding for the facility, which is included in the bill, Byron won't be able operate, according to Exelon.

House passage wasn't a given when representatives arrived in Springfield on Thursday, according to numerous lawmakers and others involved in the process. "It was a nail-biter," said one representative.

Thursday's negotiations started at 10:30 a.m. when House Speaker Emanuel "Chris" Welch met with Gov. J.B. Pritzker to talk about how they wanted to move forward. They liked Rep. Ann Williams' proposal that would require Prairie State Energy Campus, one of the newer coal plants in the country, to reduce its carbon emissions by 45 percent by 2035. That idea became part of Rep. Marcus Evans' amendment that also called for Prairie State to close its facility in 2045.

While other coal plants are closing down on their own, Prairie State's challenge is that it supplies power to numerous municipalities. Shutting down puts the power grid into question if alternative energy sources aren't meeting demand. That was a sensitive point among Metro East lawmakers, including Assistant House Majority Leader Jay Hoffman, who pushed for keeping the plant open as long as possible.

In that morning meeting, Pritzker assigned Deputy Gov. Christian Mitchell, who has been the governor's point person on all discussions related to the clean-energy bill, to represent him in the talks. Mitchell knew that decarbonization was a priority for Pritzker, who campaigned on the issue in 2018, and he was prepared to draw the line on anything that didn't include that.

By 11 a.m. Mitchell was in Welch's third floor conference room along with the speaker's three chosen negotiators: Hoffman, Evans, and Assistant House Majority Leader Robyn Gabel, who is aligned with environmentalists and, like Mitchell, wanted assurances that decarbonization was a priority.

The discussions were serious and to the point as lawmakers knew the clock was ticking. They had one day to pull a bill together. A few times during the day, they separated, and Mitchell and a few others ran downstairs to the governor's conference room on the second floor. Then they returned to the third floor. Someone ordered pizza and they ate lunch while they talked.

The final agreement wasn't one they all loved, but it's one they could all feel good about. Pritzker and environmentalists got the decarbonization they wanted, and labor got assurances that jobs would be safe and that Prairie State could stay open for a time while it figures out how to adjust to the growing urgency around climate change.

"I think Speaker Welch and leaders Evans, Gabel and Hoffman deserve tremendous credit for working in good faith with all parties to bring this home," Mitchell shared with Playbook. It goes to a phrase Welch's team has used repeatedly since he became speaker: "decentralized leadership."

Now the ball is back in Harmon's court. Two weeks ago, the Senate sent a version of the energy bill to the House knowing that Welch may have better luck working with the governor than Harmon.

Harmon "will be voting 'yes,'" on the now tweaked measure, according to a statement from his office last night. "The shared goal among the Senate, House and Gov. Pritzker has been to position Illinois as a national leader on reliable, renewable, and affordable energy policies. This proposal accomplishes that."

Lawmakers are marveling at how the bill has shaped up. "There was a time this kind of bill would have been put together in Exelon's conference room" and certainly not the Capitol, said one legislator not wanting to be named since the bill is still moving through the Senate. It would have been a bill focused on giving money to nuclear plants and, possibly, ignoring the bigger picture — decarbonization — which now gives Illinois more credibility on tackling climate change.

What else is in the energy bill: It includes "subsidies for wind and solar projects would roughly double, to about $500 million per year. The plan also would allow the state's large electric utilities to spend about $317 million in previously collected funds on renewable energy projects rather than refunding it to customers. Under existing law, the money was supposed to pay for projects that came online by May 31 of this year, but many were delayed by the coronavirus pandemic," by Tribunes' Dan Petrella.

On the heels of a powerful speech Saturday to commemorate the 20th anniversary of the Sept. 11 terrorist attacks, former President George W. Bush will be in Chicago on Tuesday to headline the 10th Annual Navy SEAL Foundation fundraiser. The event is sold out, but tickets are available to Zoom in virtually. The organization helps military veterans transition into the private sector and help families when SEAL members don't come home. This year's event chairs are Motorola CEO Greg Brown and Anna Brown, Citadel CEO Ken Griffin, insurance mogul Patrick Ryan Sr. and Shirley Ryan, Max Digital founder Patrick Ryan Jr. and Lydia Ryan, and auto entrepreneur Bob Loquercio and Veronica Loquercio. Recipient of this year's Patriot Award is David Herro, chief investment officer of International Equities at Harris Associates. On Saturday, Bush was in Shanksville, Pa., where 37 passengers and 7 crew members died after the United Airlines flight was hijacked.

The 43rd president condemned the actions of the terrorists two decades ago, and warned of the threat of domestic terrorism in the U.S. today. "We have seen growing evidence that the dangers to our country can come not only across borders, but from violence that gathers within. There is little cultural overlap between violent extremists abroad and violent extremists at home, but their disdain for pluralism in their regard for human life," he said. Manchin on a mission Having a majority in Congress ain't all it's cracked up to be. Sen. Joe Manchin on Sunday threw another wrench in Democrats' plans to pass a sweeping spending package through budget reconciliation, telling CNN's Dana Bash that he'd support a $1 trillion to $1.5 trillion bill, less than half the $3.5 trillion they currently have in mind. That's something Sen. Bernie Sanders soon after said was "absolutely not acceptable to me."

But it's not just the spending that Manchin has an issue with. "The numbers they're wanting to pay for it and the tax changes they want to make, is that competitive? Does it keep us competitive or not? I believe there are some changes made that do not keep us competitive," the West Virginia Democrat said on "State of the Union." He also suggested there should be more restrictions around the expanded child tax credit, such as work or education requirements.

The one thing we do know is that this likely means that the topline number can't be $3.5 trillion. But Democrats argue that this bill is all or mostly paid for through various revenue raisers. So the bigger question is what channels for raising revenue is Manchin OK with?

House Democrats have some ideas, which they circulated Sunday. They're talking about raising the corporate tax rate to 26.5 percent, above Manchin's preferred rate of 25 percent, according to a plan from the Ways and Means Committee obtained by POLITICO. They're also planning to call for a new 3 percent surtax on people making more than $5 million, as well as increasing the top capital gains rate to 28.8 percent from 23.8 percent.

According to the plan, the total revenue raised is $2.9 trillion, which, along with the White House's estimated $600 billion from growth, "fully offsets the $3.5 trillion package." It will already be a tall order to reconcile (ha) these two approaches. But that's not all that's going on this month.

Democrats are also trying to avoid an economic collapse and a government shutdown. Our Burgess Everett and Heather Caygle report: "There is growing worry among some rank-and-file Democrats that their tunnel-vision mentality on a $3.5 trillion budget reconciliation bill could provoke economic blowback if Republicans hold the line and tank efforts to lift the debt ceiling. And Democrats' threadbare majorities in Congress are leaving the party with little time to wriggle out of a dangerous economic morass that could overwhelm their other priorities, from voting rights to tax increases on the wealthy to a sweeping expansion of the social safety net."

TWO FED CHIEFS TO SELL STOCKS AFTER CONTROVERSY — WSJ's Michael Derby: "The leaders of the Boston and Dallas Federal Reserve Banks said they would sell off individual stocks they own, invest the proceeds in diversified indexed funds or cash savings and cease trading in individual securities.

"The Thursday announcement comes after the Federal Reserve Bank of Dallas this week disclosed that its president, Robert Kaplan, bought and sold millions of dollars in stocks and other investments in 2020. A disclosure from the Boston Fed showed that its president, Eric Rosengren, also was an active trader last year, albeit at a smaller scale. Both men defended their actions as consistent with their respective bank's code of conduct policies, but said they didn't wish to create any perception that their trading of securities and investments would conflict with their role in setting monetary policy."

STABLECOINS COULD FACE CRACKDOWN — Bloomberg's Jesse Hamilton and Saleha Mohsin: "U.S. officials are discussing launching a formal review into whether Tether and other stablecoins threaten financial stability, scrutiny that could lead to dramatically ramped-up oversight for a fast-growing corner of the crypto market.

"After weeks of deliberations, the Treasury Department and other federal agencies are nearing a decision on whether to launch an examination by the Financial Stability Oversight Council, said three people familiar with the matter who asked not to be named in commenting on closed-door discussions. FSOC has the power to deem companies or activities a systemic threat to the financial system -- a label that typically sets off tough rules and aggressive monitoring by regulators."

WYDEN PROPOSES CRACKDOWN ON PARTNERSHIPS, STOCK BUYBACKS — Our Brian Faler: "Finance Committee Chair Ron Wyden (D-Ore.) on Friday unveiled a proposal aimed at making it easier for the IRS to audit partnerships, an area where the agency has struggled. Separately, he and fellow tax writer Sen. Sherrod Brown (D-Ohio) introduced a plan to impose a 2 percent excise tax on publicly traded companies buying back their own stock.

"Together, the proposals — both of which are aimed at the rich — are estimated to raise more than $270 billion, which the lawmakers want to use to defray the cost of a welter of new spending initiatives."

INVESTORS EYE WOBBLING ENERGY SECTOR AS GAUGE FOR DELTA FEARS — Reuters' David Randall: "Energy stocks are becoming a popular bellwether for concerns over how deeply the Delta variant of the coronavirus is expected to impact the U.S. economy, as the so-called reopening trade that boosted some parts of the market earlier this year continues to stumble. The S&P 500 energy sector is down 12.3 percent for the quarter-to-date compared with a 3.7 percent gain for the S&P 500, which stands near record highs. That contrasts with the sector's performance in the first quarter of the year, when it zoomed 29.3 percent on expectations that a vaccine-fueled economic rebound will boost energy demand."

ANALYSTS WARN STOCK MARKET FACES RISK OF BUMPY AUTUMN — WSJ's Caitlin McCabe: "After a record-breaking bull run for the U.S. stock market this year, many Wall Street analysts are starting to warn that investors could be in for a bumpy ride in the coming weeks and months. Analysts at firms including Morgan Stanley, Citigroup Inc., Deutsche Bank AG and Bank of America Corp. published notes this month cautioning about current risks in the U.S. equity market. With the S&P 500 already hitting 54 records this year through Thursday — the most during that period since 1995 — several analysts said that they believe there is a growing possibility of a pullback or, at the least, flatter returns."

BACK-TO-SCHOOL SEASON HAS STOCK SELLERS TAPPING MARKET IN DROVES — Bloomberg's Swetha Gopinath and Julia Fioretti: "Global equity capital markets are firing on all cylinders, with a raft of listings and billions of dollars in stake sales hitting traders' screens this week, as sellers rush to take advantage of buoyant prices while they can. September traditionally marks the start of the fall window for stock offerings, and the month is off to its busiest start globally since 2012, with nearly $40 billion of deals priced last week alone, according to data compiled by Bloomberg. Initial public offerings worth billions more are in the market, looking for takers."

LIBOR TRANSITION STOKES SALES OF RISKY CORPORATE DEBT — WSJ's Sebastian Pellejero: "Wall Street's shift away from Libor is fueling sales in the red-hot market for bundles of risky corporate loans. Managers of collateralized loan obligations — securities made up of bundled loans with junk credit ratings — are rushing to close deals ahead of the year-end move away from the London interbank offered rate. The interest-rate benchmark underpins trillions of dollars of financial contracts but was scheduled for phaseout after a manipulation scandal."

ICYMI: WHITE HOUSE COMPETITION COUNCIL SEEKS LOWER CONSUMER PRICES — AP's Josh Boak: "A new White House council on U.S. economic conditions held its first meeting Friday, with participants highlighting at least 18 actions taken to help consumers and potentially lower prices. The council, an outgrowth of a July executive order by President Joe Biden, is aimed at refocusing the U.S. economy around the interests of consumers, workers and entrepreneurs. Details about the meeting were provided by two administration officials who spoke on condition of anonymity to preview the gathering. The goal is to foster a more dynamic economy in which competition among companies leads to more transparency, greater choice and potential savings for customers."

BOFA REVAMPS LEADERSHIP — NYT's Lananh Nguyen: "Bank of America made sweeping changes to the company's leadership Friday that elevated several executives, including three women, to senior jobs and all but guaranteed that Brian Moynihan, the chief executive, would remain at the helm of the nation's second-largest bank for years to come. The company promoted Alastair Borthwick, its current head of commercial banking in New York, to chief financial officer. It also gave more responsibilities to Dean Athanasia, who runs the consumer-banking division from Boston. Lauren Mogensen was elevated to general counsel."

Importantly, 1031 helps house our communities. Multifamily housing transactions represent 40% of like-kind exchanges, more than any other building type . Limiting 1031 exchanges would increase the cost of rental housing and significantly raise rents at a time when America is facing a housing affordability crisis.

Businesses and workers who welcome us into their buildings have been hard hit by the pandemic, but they are resilient in reopening. As America works to emerge, like-kind exchanges will help a new generation of entrepreneurs create jobs and opportunities, and generate new tax revenue, for our communities.
